Under The Law, Once A Father Acknowledges A Child, No Third Party Can Contest It – Nigerian Lawyer Says As She Calls Mohbad’s Father A ‘’Busybody’’ For Demanding A DNA

Amidst the ongoing paternity dispute over Liam, the sole child of the late singer Mohbad, Nigerian family lawyer Onifade Olamide has clarified the legal implications.

According to Olamide, once a man acknowledges a child as his own, no third party can legally contest the paternity. This principle applies even if the child’s biological father is deceased.

In this case, Mohbad acknowledged Liam as his child during his lifetime. Therefore, Olamide argues that his father, Joseph Aloba, who has requested a DNA test, lacks standing to challenge the paternity.

Olamide explained that under the law, when a married couple has a child, the husband is presumed to be the biological father (“Presumption of Legitimacy”). This presumption can only be rebutted if it is proven that the child is not the husband’s.

Since Mohbad acknowledged Liam as his own, Olamide contends that Aloba would have to provide compelling reasons to obtain a court order for a DNA test. However, as the presumed father is deceased, it is unlikely that such an order would be granted. CONTINUE READING
